Real Estate Mediation
Any party to a real estate transaction -- sellers, buyers, brokers, builders, home inspectors -- can initiate mediation of a dispute. In the past, when negotiations failed, parties took their case to court. Today, they have the choice of making effective agreements through mediation.

When a mutually acceptable solution has been reached, the mediator prepares a written agreement detailing the settlement terms. Once the settlement agreement is signed, the parties are legally bound.

The Arizona Association of Realtors has established a Dispute Resolution System ("DRS") specifically designed for quick and inexpensive mediation of any kind of real estate dispute. Out-of-Court Solutions is an approved Mediator for the Arizona Association of Realtors.

Mediation fully belongs to the parties - not an outside judge or arbitrator who imposes a decision. The parties make all decisions and determine the outcome of the dispute. If a settlement is not reached, the parties are free to arbitrate or litigate as if the mediation never took place.
