| Employment Disputes |
| When left to fester, employee dissension based on claims of unequal treatment, age, race, religion, disability, sexual harassment, or any other type of discrimination is likely to result in decreased productivity and increased legal expense. Employment mediation affords the neutrality, expertise, and confidentiality required to address concerns and reach mutually acceptable agreements. How does it work? Upon the request of an employee and employer, and/or their attorneys, Out-of-Court Solutions explains the employment mediation process to the other(s) involved in the conflict, issues an invitation to participate, and arranges the mediation. The mediation begins with the mediator explaining certain rules and procedures, and asking the participants to share their individual perspectives, concerns, and goals. The sessions that follow involve a series of joint and separate conferences -- with the mediator helping the participants communicate, negotiate, resolve issues, and reach agreement. Upon resolution, the mediator will, if requested, prepare a settlement agreement. Why use a professional mediator? “It’s difficult to see the picture when you’re inside the frame,” (R.S. Trapp). As objective and highly skilled facilitators, the mediators with Out-of-Court Solutions generate effective communication, respectful negotiations, constructive problem-solving, and informed decision-making. The parties may choose to involve their lawyers, but as “consultants” not “combatants.”How much does it cost? Most conflicts are resolved in one or two days -- rather than the months, if not years, involved in court proceedings. The cost is a small fraction of arbitration or litigation. The bottom line is that employment mediation is inexpensive compared to using two or more separate and adversarial lawyers. For more information, please call Out-of-Court Solutions at (602) 404-1500 or click here to contact us by email. |
