What is prenuptial mediation?

A Prenuptial Agreement (also known as a “Premarital Agreement”) is a written contract that is made in contemplation of marriage and becomes effective on the date of marriage. It typically provides for the maintenance of certain property, debts, income and expenses as separate versus marital (“community”) property. A prenuptial agreement can also address other legal matters such as inheritance and spousal maintenance (formerly known as “alimony”).

Wouldn’t my fiancé be upset if I asked for a Prenuptial Agreement?

Typically it’s not what you say but how you say it, and love and logic can coexist. In fact, more and more couples are using the prenuptial process to stimulate constructive conversations about their respective expectations, concerns and responsibilities regarding the financial aspects of their marriage. A premarital agreement can be and often does solidify a relationship and make marital disagreements much less likely.

Why not just use a lawyer to draft a Prenuptial Agreement?

It would be unethical for a lawyer to represent both you and your fiancé, whereas the Questionnaire (See Sample) that we provide eliminates all of the time and expense you would otherwise incur if you were to have one attorney draft a Prenuptial Agreement and another review and most likely re-draft certain provisions. With our Prenuptial Agreement program, you and your fiancé will literally save hundreds if not thousands of dollars, and have the option to confer with one of our professional mediator who has backgrounds in both law and psychology

What does the mediator do?

Our mediators foster effective communication, offer diverse alternatives for resolution of issues, and provide legal, financial and tax information. We ensure that couples make fully informed decisions about each and every aspect of a prenuptial agreement, including property rights and interests, the handling of income and debts, nonmonetary contributions to a marriage, inheritance, life insurance and allof the other legal and financial matters attendant to marriage.
